ACGGOODS Copyright Policy

General Principles

ACGGOODS only accepts designs that are original or legally authorized.

All files, artworks, and related materials submitted by artists must not infringe upon any third-party intellectual property rights, trademarks, publicity rights, or other legal rights.

The platform reserves the right to review, remove, or terminate collaborations at any time.

Artists must provide valid identity information and contact details, and tax information if required, to ensure compliance with copyright and payment regulations.

Fan Art and Derivative Works

The artist should respect the regulations of each copyright holder and create derivative works within the allowed scope. Specific inquiries regarding creation and sales rights should be directed to the respective copyright holders.

Unauthorized fan art will be removed immediately once discovered or upon receiving a complaint, and further actions may be taken against the artist.

Artist’s Warranties and Responsibilities

Artists guarantee that submitted works are their own original creations or are fully authorized.

Any claims, disputes, or liabilities arising from copyright, trademark, or publicity rights issues shall be borne solely by the artist. The platform may handle such matters first and directly deduct related costs from unsettled earnings, and if insufficient, seek further reimbursement from the artist.

If infringing works have already been sold, the artist shall bear all refunds, compensation, and related costs. The platform may refund customers first and deduct or recover the costs from the artist.

Artists must ensure that submitted works do not create conflicts of interest during cooperation. For “collaboration works,” if artists intend to sell them elsewhere, they must notify the platform in advance. The platform reserves the right to require exclusivity or differentiated sales.

In case of copyright disputes, artists shall provide written statements or legal assistance to the platform, including but not limited to authorization documents, source files, and cooperation with rights holders.

Complaint and Takedown Procedure

Upon receiving a complaint from a rights holder or third party, the platform will conduct a preliminary review within 3 business days and may temporarily remove the related product.

The platform will notify the artist within 5 business days and provide an appeal window of no more than 7 business days.

If the artist fails to respond within the given time or fails to provide valid evidence, the platform may proceed with a final takedown decision.

For repeat infringers (two or more violations), the platform reserves the right to impose measures including but not limited to: upload restrictions, earnings freeze, permanent removal, or termination of cooperation.

Products already sold will not be recalled, but all subsequent production and sales will be halted.

Prohibited Content

The following content is strictly prohibited:

Works that infringe upon copyrights, trademarks, or publicity rights of others.

Works that use brand logos, trademarks, film/game characters, or celebrity likenesses without authorization.

Content involving political propaganda, pornography, hate, violence, or anything inconsistent with the platform’s values.

AI-generated images, texts, or other works.

Platform Usage Rights

Artists agree that ACGGOODS may use their submitted works for promotion, sales, and related marketing activities, including but not limited to product mockups, advertisements, social media promotion, trade show materials, and brand collaborations.

The platform will not resell or use the works beyond the scope of this collaboration.

Earnings and Taxation

The platform reserves the right to withhold part of the artist’s earnings as a risk reserve before settlement, to cover potential copyright or consumer disputes.

Artists are solely responsible for reporting and paying taxes in accordance with their local laws, unless legally mandated otherwise.

Governing Law and Dispute Resolution

This policy shall be governed by the laws of the Hong Kong Special Administrative Region.

Without conflicting with Hong Kong law, both the platform and the artist shall also comply with applicable international copyright conventions and cross-border e-commerce regulations (including but not limited to DMCA Takedown).

Any disputes arising from or related to this policy shall first be resolved through friendly negotiation; if unresolved, they shall be submitted to the courts of the Hong Kong Special Administrative Region with jurisdiction.
